General conditions

I INITIAL PROVISIONS
1 NFDTV.TV server (hereinafter referred to as “server”) is a public internet server providing various services for private individuals (hereinafter referred to as “user”).
2 Commercial as well as non-commercial services provided for users are free, unless stated otherwise in these terms.
3 NFD TV k. s. is the provider of the server (hereinafter referred to as “provider”).
4 Duties of the provider and users are stated in these rules. Users who do not agree with these terms are not allowed to use services provided by the server provider.

II USER REGISTRATION
1 Registration of user with the server is not obligatory; with registration the user has access to more options compared to the people not registered with the server.
2 Users can register and log in to the coded part after they have fulfiled the following criteria:
(a) they have bought a Starting pack together with a ticket for the Basic training on www.seminar.nfd.sk or in the e-shop on www.nfd.sk (in Member Zone)
(b) they are members of CLUB NFD
(c) they have filled in an application for University NFD TV and agreed with the monthly tuition fee.

III CANCELLING REGISTRATION
1 Registration can be cancelled by the user as follows:
a) if the user does not pay the tuition fee even after the appeal period expires
b) if the user requests to cancel the registration.
2 Provider reserves the right to cancell the registration or to deny access of a user not following the rules and/or legal statutes of the state or if the provider is aware that the user has violated a law and is prosecuted, or if the user’s action damages NFD, NFDTV, GI Inc., Loyal Bank or any partner of NFD.
3 After the user’s registration is cancelled, the provider has the right to store the information entered by the user for an unlimited period (it is the IP address of the computer and the login times of the user). After the registration of the user is cancelled, the server stores all public contributions of the user (e. g. comments in discussions, jokes, recipes and others).

IV USER’S PRIVACY
1 Provider commits not to provide the user’s private data to a third party.
2 Private data of the user in these terms mean all data not publically accessible to other users or not shared otherwise. IP address of the computer and login times of the user are not treated as the user’s private data.

V USER’S DUTIES
1 User is aware that by using services on the server they cannot violate legal statutes of the Slovak Republic or Poland and/or general morals, which means that they can in no way:
a) promote violence and inspire open or hidden hatred based on sex, race, colour of skin, language, belief and religion, political or other opinions, national or social origin, national or ethnical background;
b) promote war or describe cruel or inhumane action in a derogating, justifying or approving way;
c) in open or hidden way promote alcohol, alcoholism, smoking, using drugs, poisons and precursors or to derogate the effects of using these substances;
d) use vulgar words, idioms or other verbal or sign expressions with the direct or indirect meaning contradicting the generally acceptted morals and ethics;
e) threaten physical, psychical or moral development of young people or to damage their mental health and emotional state;
f) send contributions with erotic content;
g) promote child pornography;
h) promote a political party or its representatives in an open or hidden way;
i) provide advertising for any natural or legal person, any products or services in an open or hidden way;
j) promote medicaments which can be distributed on the basis of a medical prescription or a veterinary prescription and which contain intoxicants or psychotropic substances not limited to medical prescriptions and paid from health insurance in accordance with special regulations for medicaments not registered in Slovakia or Poland which mention effects of medication on tuberculosis, sexually transmitted diseases, serious infectious diseases, tumorous conditions, chronic insomnia, metabolism disorders and mental diseases;
k) promote weapons and ammunition or to describe the aforementioned in an open or hidden way;
l) promote and execute any other form of action which contravenes legal statutes of the Slovak Republic or Poland;
m) publish untrue, unverified, confusing or deceptive information about a third subject, especially if the information can bring profit to the third subject;
n) circumvent the above mentioned restrictions.
2 User is not allowed to prevent other users from discussion on the server or to interfere such discussion. User cannot harras other users.
3 User is not entitled to any kind of reward for their contributions published on the server.
4 Provider is not responsible for the content of contributions or discussion; provider is not responsible for violation of copyright law or other rights by users. Each user takes responsibility for their contributions and agrees not to use server services for purposes which contravene legal statutes of the Slovak Republic and Poland.
5 User shall not attempt to log in to the server as another user or otherwise impair other users or other persons.
6 User can in no way impair the provider and provider’s reputation. User is not allowed to promote services of other persons who are direct or indirect competition to the provider.
7 User is not allowed to copy or imitate videos provided by Univesity NFD TV. It is strictly forbidden to manipulate passwords and access to paid videos. It is forbidden to lend passwords to other users.
8 Provider warns the users that they are obligated to protect their access passwords to paid videos and keep them safe so that they cannot be abused. Provider is not responsible for any damages caused by the password abuse. If the provider has a suspicion concerning password abuse, the user can be asked to update their password.

VI RULES FOR ADDING PHOTOGRAPHS
1 User is commited to add photographs with copyright or author’s consent only.
2 User is not allowed to add photographs contradicting morals or legal statutes of the Slovak Republic and Poland, including erotic and pornographic photographs.
3 Rules for adding photographs stated in sections 1 and 2 apply to all photographs added to the server by the user, especially to the profile and photoalbums.

VII PRICE
1 User is not obligated to pay for services provided by the provider on the server, with the exception of paid services where it is necessary to use the password which clients edited when he registry. Monthly payment for using paid information is called “tuition fee”.
2 Tuition fee for University NFD TV is set to USD 15.00 per month. Provider reserves the right to change the price.
3 Tuition fee shall be paid monthly. User shall send the Application to University NFD TV and thus agree with the payment of USD 15.00 being deduced once a month from any money transfer to their account in Loyal Bank.
4 If the user’s application for University NFD TV is accepted, they shall receive a right of access within 24 hours since the first tuition fee is accepted.
5 Tuition fee is not refundable. If the user provides passwords to third persons, they shall be fined with USD 1,000.00.

VIII PROMOTION ON THE SERVER
1 Users agree with the following:
a) their advertisement shall be displayed on the server;
b) they shall receive advertising e-mails – newsletters.

IX RIGHTS AND DUTIES OF THE PROVIDER
1 Provider has no other duties towards users or third persons in relation to the services provided on the server, besides the duties stated in these terms.
2 Provider is not responsible for the content of the contributions and discussion in the chat on the server.
3 Provider does not guarantee continuous functioning, perfect work and security of the server. Provider is not responsible for any possible damage that might be caused to the user in relation to use of services on the server.
4 Provider has the right to cancel user’s registration anytime without giving any reason. Provider has the right to stop providing services on the server anytime for a limited, unlimited period or permanently. Provider has the right to disconnect the server anytime, without previous notice.
5 If the provider is fined for breaching the provider’s duties stated in these terms and legal statutes of the Slovak Republic and Poland, user is aware of the obligation to pay the provider for damages thus caused in full.

X CHANGE OF TERMS
User is aware of and agrees with the provider’s right to change these terms anytime.

XI ABIDING BY LEGAL NORMS
Using services on the server, user is obligated to abide by legislation of the state where they reside, as well as legislation of Poland. If they fail to do so, or they fail to fulfil their duties stated in these terms, provider can submit all available information about the user (including personal data of the user) to authorized persons.
